Order Confirmation

Your order will be processed upon receipt of the completed and signed order form or upon completion of the online checkout process. An order confirmation will be sent to the provided email address within 24 hours of processing.

 

Purchases

When you purchase an item from us, you agree that:

• You are responsible for reading the full item listing before making a commitment to buy.

• You enter into a legally binding contract to purchase an item when you complete the checkout payment process or sign the order form.

 

Pricing

The prices we charge for our products and subscriptions are listed on the Website and on the order form. We reserve the right to change our prices at any time and to correct any pricing errors that may occur. Additional information about pricing and sales tax is available on the orders page.

 

Subscription Plans

We offer subscription plans for our MYND Adventure Kits in 3-month and 6-month options. You will receive a unique MYND Adventure Kit delivered to your door each month during your subscription period. At checkout, you can choose between our Junior Edition (for ages 6-12) or Teen Edition (for ages 13 and up). If you have a specific kit in mind that you would like to receive in your subscription, please let us know during the checkout process, and we will do our best to accommodate your request based on stock and availability of the kits. Only kits that are active on the website at the time of your purchase or the start of your subscription will be considered for this request.

 

Payment Terms

• Payment Due Date: Payment is required prior to the shipment of online orders. For other orders, payment is required within 30 days of the invoice date. The invoice will be issued upon shipment of the order.

• Payment Methods: Accepted payment methods include credit card, bank transfer, or check. Details for payment will be provided in the invoice sent with your order confirmation.

• Late Payments: Late payments may be subject to a late fee of 1.5% per month on the outstanding balance.

• The fee for the products and any other charges you may incur in connection with your purchase, such as taxes and possible transaction fees, will be charged to your payment method at the time of purchase for online orders.

 

Shipping and Delivery

• Shipping Timeline: Orders will be shipped within one week of receiving the signed order form or online order confirmation.

• Shipping Address: It is the customer's responsibility to provide an accurate shipping address. MYND Adventures is not responsible for delays or losses due to incorrect shipping information.

 

Cancellation and Changes

• Order Changes: Any changes to the order must be made within 24 hours of submitting the order form or completing the online order.

• Cancellation Policy for Single Kit Orders (aka: not subscription plans): Orders can be cancelled within 24 hours of submission without any charges. Cancellations after this period may incur a restocking fee of 20% of the order value.

• Cancellation Policy for Subscription Plans: You may cancel your subscription within 24 hours of purchase or at up to 10 days before the next billing cycle or scheduled shipment date. If you cancel after this window, the current month's kit will be billed and shipped. However, you can cancel for the following month, and you will not be charged for the remainder of your subscription.

 

Returns and Refunds

• Return Policy: Returns are accepted within 14 days of receipt of the shipment. The items must be in their original condition and packaging.

• Refund Process: Upon receipt and inspection of the returned items, a refund will be processed within 7 business days. Shipping costs are non-refundable, and the customer is responsible for return shipping charges.

• Damaged or Defective Items: If you receive damaged or defective items, please contact us within 7 days of receipt to arrange for a replacement or refund. For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. Products can be returned only in the country in which they were originally purchased. The following products are not eligible for return: open or damaged items, kits that have been used.

 

Use of Products

By purchasing our products, you agree to use them in a safe manner and ensure that children use them under appropriate

supervision. MYND Adventures is not liable for any injuries or damages resulting from misuse of our products. The buyer assumes full responsibility for ensuring the products are used safely and as intended.

 

Limitation of Liability

MYND Adventures is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products. To the maximum extent permitted by applicable law, MYND Adventures shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Website or the service.

 

Privacy Policy

We are committed to protecting your privacy. Any personal information collected will be used solely for processing your order and will not be shared with third parties without your consent.

 

Governing Law

These terms and conditions are governed by the laws of the state in which MYND Adventures operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in that state.

 

Changes to Terms and Offerings

We reserve the right to modify these Terms from time to time at our sole discretion. When we make changes to the Terms, we will notify you that changes have been made. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

Promotional Emails and Content

You agree to receive promotional messages and materials from us by mail, email, or any other contact form you may provide us with. If you do not wish to receive such promotional materials, please notify us at any time.

 

Intellectual Property

The Website and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto, are the exclusive property of MYND Adventures and Games, including all MYND Adventure Kits and related content. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights.

 

Warranties and Responsibilities

When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to the customer, and the customer will be responsible for return shipment of the product to us.

 

User Content

By uploading any content to the Website, you confirm that you own all the relevant rights or have received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed on the Website.

 

Account Suspension or Termination

We may permanently or temporarily terminate or suspend your access to the Website without notice and liability for any reason, including if, in our sole determination, you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account at any time. With respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

 

Indemnification

You agree to indemnify and hold MYND Adventures harmless from any demands, loss, liability, claims, or expenses (including attorneys' fees), made against them by any third party due to, or arising out of, or in connection with your use of the Website or any of the services offered on the Website.

 

Limitation of Liability
